Terms of Service

1. Acceptance of these Terms

MyBuildPlanner (the “Service”), located at mybuildplanner.com and operated by MyBuildPlanner (“we,” “us,” or “our”), provides free interactive planning tools for do-it-yourself projects. By accessing or using the Service, you agree to be bound by these Terms of Service (“Terms”) and by our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service. By using the Service, you represent that you meet this requirement and that you have the legal capacity to enter into these Terms.

3. The Service

MyBuildPlanner generates estimates of the materials, hardware, tools, quantities, costs and build times for DIY construction projects based on the inputs you provide and standard construction rules of thumb. All output is informational and is intended to help you plan, budget and shop for a project.

4. Estimates and no professional advice

The Service produces planning estimates — not engineered designs, architectural or structural drawings, or professional advice. Quantities, cost ranges, build times and code-related notes are approximations that vary with your specific conditions, local pricing, material grades, site factors and applicable building codes. You are solely responsible for verifying all measurements, structural requirements, spans, footings, setbacks and material specifications, for confirming code compliance, and for obtaining any required permits and professional review before purchasing materials or beginning construction. Any reliance you place on the Service is at your own risk.

5. License and acceptable use

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial planning purposes. You agree not to:

• use the Service for any unlawful purpose or in violation of these Terms;
• copy, scrape, reproduce, resell, or commercially exploit the Service or its content without our prior written permission;
• interfere with, disrupt, or attempt to gain unauthorized access to the Service or its underlying systems;
• use automated means to access the Service in a way that sends more requests than a human could reasonably produce; or
• reverse engineer or attempt to derive the source code of any part of the Service, except to the extent this restriction is prohibited by law.

6. Intellectual property

The Service and all of its content, features and functionality — including text, calculators, designs, graphics, logos and software — are owned by MyBuildPlanner or its licensors and are protected by copyright, trademark and other intellectual property laws. The estimates and shopping lists the Service generates for your own project are yours to use for that project.

7. Third-party links and affiliate relationships

The Service contains links to third-party websites and retailers, including Amazon, The Home Depot, Lowe’s and Walmart. We participate in affiliate programs and may earn a commission when you purchase through these links, at no additional cost to you. We do not control and are not responsible for the content, products, pricing, availability or practices of any third-party website. Prices and availability shown by retailers change frequently and are determined solely by those retailers. Your dealings with any third party are solely between you and that third party.

8. Advertising

The Service may display advertisements served by third parties, including Google. These third parties may use cookies and similar technologies to serve ads based on your prior visits to this and other websites, as described in our Privacy Policy.

9. Disclaimer of warranties

The Service is provided “as is” and “as available,” without warranties of any kind, whether express, implied or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the Service will be uninterrupted, error-free or secure, or that any estimate, quantity, cost or other output is accurate, complete or suitable for your project. To the maximum extent permitted by law, all such warranties are disclaimed.

10. Limitation of liability

To the maximum extent permitted by law, in no event will MyBuildPlanner or its owners, operators, contributors or suppliers be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, materials, time, data or goodwill, or for any property damage or personal injury, arising out of or relating to your use of, or inability to use, the Service, whether based on warranty, contract, tort or any other legal theory, even if advised of the possibility of such damages. To the maximum extent permitted by law, our total aggregate liability for all claims relating to the Service will not exceed one hundred U.S. dollars (US$100).

11. Indemnification

You agree to indemnify, defend and hold harmless MyBuildPlanner and its owners and operators from and against any claims, liabilities, damages, losses and expenses, including reasonable attorneys’ fees, arising out of or in any way connected with your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

12. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use and share information.

13. Modifications to the Service

We may change, suspend or discontinue any part of the Service at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension or discontinuation of the Service.

14. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the “Effective date” above. Your continued use of the Service after the changes become effective constitutes your acceptance of the revised Terms.

15. Termination

We may suspend or terminate your access to the Service at any time, for any reason, without notice. Provisions of these Terms that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability and indemnification — will survive.

16. Governing law and disputes

These Terms are governed by the laws of the State of [State], United States, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the state and federal courts located in [County, State], and you consent to personal jurisdiction in those courts.

17. General

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect. Our failure to enforce any right or provision is not a waiver of that right or provision. These Terms, together with our Privacy Policy, constitute the entire agreement between you and MyBuildPlanner regarding the Service and supersede any prior agreements.
